Terms of Service

1. Introduction

Welcome to Fifitox (“we,” “our,” or “us”). By accessing or using the Fifitox platform — including our website, mobile-optimised web app, and any related services — you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.

2. Services

Fifitox is Nigeria’s AI-curated gifting platform. We connect customers with vendors to facilitate the purchase, packaging, and delivery of curated gift boxes. We also provide an AI assistant (“Fifi”) to help customers select appropriate gifts.

3. Accounts

You must provide a valid Nigerian phone number to create an account. You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate these terms.

4. Orders & Payments

All prices are displayed in Nigerian Naira (₦). Payments are processed by Paystack, a third-party payment processor. By placing an order, you authorise Fifitox to charge the amount shown at checkout. Orders are confirmed only after successful payment. We reserve the right to cancel orders in cases of stock unavailability or suspected fraud.

5. Delivery

We aim to deliver within 1–3 business days within Lagos and 2–5 business days nationally. Delivery timelines are estimates and may vary. Fifitox is not liable for delays caused by third-party couriers, recipient unavailability, or incorrect delivery addresses provided by the customer.

6. Refunds & Returns

If your order arrives damaged or does not match what was described, please contact us within 24 hours of delivery with photo evidence. We will assess each case individually and may offer a replacement or store credit. We do not offer cash refunds for change-of-mind purchases once an order has been dispatched.

7. Vendor Terms

Vendors on the Fifitox platform must provide accurate product information and maintain sufficient stock for listed items. Fifitox charges a commission on each sale as agreed during vendor onboarding. Vendors are responsible for product quality and must comply with applicable Nigerian consumer protection laws.

8. AI Features

Fifi, our AI gift curator, provides recommendations based on information you share. These recommendations are suggestions only — Fifitox does not guarantee that any gift will meet the personal tastes of the recipient. The AI uses a third-party language model (Anthropic Claude) to generate responses.

9. Intellectual Property

All content on the Fifitox platform — including the Fifi brand, logo, copy, and design — is owned by Fifitox or its licensors. You may not reproduce, distribute, or create derivative works without prior written permission.

10. Limitation of Liability

To the maximum extent permitted by Nigerian law, Fifitox is not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability for any claim shall not exceed the amount you paid for the order in question.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of Lagos State.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via SMS or by posting a notice on the platform. Continued use after changes constitutes acceptance of the new Terms.
